Kaebox Driver Agreement

Background Check Process

All Drivers are required to have a background check conducted by a third-party Credit Reporting Agency ("CRA" and "Background Check"). During registration as a Driver, you are required to provide Kaebox with a valid driver's license, Social Security Number, and written consent for Kaebox to conduct a Background Check. This must be done prior to performing any Trips. Kaebox may request, at their sole discretion, at any time thereafter, and without any additional consent from you, to re-run a background check as may be allowed pursuant to applicable law.

The KAEBOX Background Check Process consists of a nationwide criminal background check, social security number trace, sex offender registry search, and Motor Vehicle Record (MVR) report and does not include a credit check.

In order to be eligible to perform certain Trips and to help protect against theft and fraud, Drivers may be asked to submit additional personal information to verify their identity, including biometric information or identifiers such as a selfie, scan of their driver's license and/or other government ID or photo.

KAEBOX uses various third-party technology, tools, and services to collect your personal information and biometric data from you. For more information on how your personal information and biometric data are used and disclosed, please see our Privacy Policy.

The Kaebox Privacy Policy applies to all platforms and services Kaebox offers, including the website Kaebox.com and/or mobile applications (collectively "Services") and applies the same to all users, whether you are a driver who picks up, carries, or drops-off packages ("Driver"), someone using our Services to send packages with a Driver ("Customer"), the recipient of packages ("Recipient") or someone who signs-up to potentially use our Services (collectively "Users").

BY USING OUR SERVICES OR BY OTHERWISE PROVIDING US WITH YOUR INFORMATION, YOU AGREE TO THIS PRIVACY POLICY. 
If you do not agree with the Kaebox Privacy Policy, you should refrain from using our Services or provide us with any of your personal information. You should also review the Kaebox Terms and Conditions, which also apply to your use of the Services.

KAEBOX does not conduct Background Checks or screening on any Customer for the purposes of allowing them to access and use our Platform to arrange for Pick up/Delivery Services

KAEBOX reserves the right to conduct such checks and screening of Customers as it deems appropriate at its sole discretion.

Kaebox Firearms Prohibition Policy

Kaebox prohibits drivers from carrying firearms of any kind while using the Kaebox app*

Anyone who violates this policy may lose access to Kaebox as stated in the terms.

*To the extent permitted by applicable law.

 

Drivers' Responsibilities

Drowsy Driving Policy

Every driver or the delivery person who uses the Kaebox platform has a responsibility to drive safely and follow the established rules of the road. If we receive serious or repeated reports of drowsy driving, the driver or delivery person may lose access to their account.


Dangerous Driving Policy

Every driver who uses the Kaebox platform has a responsibility to drive safely and follow the established rules of the road and all applicable laws. If we receive serious or repeated reports of dangerous driving and/or violations of applicable driving laws, the driver or delivery person may lose access to their account as stated in the terms.


Zero Tolerance Policy

Every driver who uses the Kaebox platform has a responsibility to drive safely and follow the established rules of the road. Kaebox has a zero-tolerance policy for the use of alcohol or drugs by drivers using the Driver app. If we receive reports of suspected impaired driving, the driver may lose access to their account, as stated in the terms.

Every driver has a duty and obligation to know and comply with all applicable federal and state laws relating to the pick-up and delivery of packages on any Trip, including without limitation, those laws governing the transportation of items over State lines, prohibiting the transportation of certain items both within a State and between States, and age restrictions.

Kaebox has no liability or responsibility to a Driver or any third party if a Driver fails to comply with these Terms or with applicable laws with respect to the performance of the Trip.

 

Kaebox Kit

When you become a driver for Kaebox, you will receive the Kaebox Kit, which contains packaging, shipping labels, and a portable printer. The Kaebox Kit must be exclusively used for Kaebox services only and is prohibited for any and all other use. If you do not use the items in the kit for a period of 90 days, we request that you please return the kit. You will be provided with a shipping label. If you fail to return the Kaebox Kit within 10 days after the expiration of the 90 days of no use, you will be assessed a charge of $350. 

Drivers or Kaebox's Kit holder is prohibited, for example, but not limited to using the equipment for any purpose other than Kaebox shipment, destroying, subleasing, selling, or any other use without written consent from Kaebox L.L.C. 

Kaebox reserves its right to pursue civil and or criminal action against the abuse of the Kaebox Kit.

 

Permits, Auto Insurance and Health Insurance

Because Drivers act as their own employer in providing Delivery Services via the Kaebox Platform, Kaebox does not and has no responsibility to provide or pay for licenses, permits, or insurances required by Driver to perform Delivery Services via the Kaebox Platform. Many states require a Driver to have permits and/or licenses to carry out certain Trips. Some insurance companies require a Driver to have commercial insurance if using a personal vehicle for business purposes. Therefore, Drivers should be aware that their standard automobile liability insurance may not provide them with coverage while they are engaged in performing a Trip or while logged into the App.

Kaebox does not provide health insurance, or any other compensation to Drivers if they are injured while performing a Trip. Kaebox does not carry workers' compensation insurance for any Driver unless specifically required by State law. For these reasons, all Drivers are required to have adequate health insurance prior to performing a Trip. You are in the best position to know if you are physically capable of handling a Trip that you agree to provide services for and Kaebox is not liable to you for any costs or damages you may suffer if you are injured while performing a Trip.

At all times, you are solely responsible for the costs of medical care/treatment you incur as a result of any injury.

It is a Driver's responsibility to comply with the required and/or recommended auto insurance, health insurance, licenses and permits, and to procure the same, prior to offering any Trips.

A Driver must have valid auto insurance in such amounts as required by State Law and its insurer to cover Driver's performance of any Trips through the Kaebox Platform PRIOR to offering any Trips. A Driver will not be allowed to perform any Trips and will be removed from the Platform if the Driver does not have the required auto insurance coverage required by the State.

A driver must carry proof of all required auto insurance coverage at all times while performing Trips and must provide the same to Kaebox and/or other authorities and officials upon request.

A DRIVER MUST HAVE THE REQUIRED INSURANCE, LICENSES, AND PERMITS TO CARRY ALL ITEMS CONTAINED IN TRIP.

ALL DRIVERS SHOULD CHECK WITH THE APPROPRIATE PARTIES, AGENCIES, AND/OR ENTITIES TO ENSURE THAT THEY ARE COMPLIANT WITH THE REQUIRED INSURANCE, LICENSES, AND PERMITS BEFORE PERFORMING ANY TRIPS.

KAEBOX BEARS NO RESPONSIBILITY OR LIABILITY FOR ANY DRIVER OR CUSTOMER NOT HAVING THE PROPER PERMITS, LICENSES, AND/OR INSURANCE TO ENTER INTO THE TRANSACTIONS AGREED UPON ON THE PLATFORM.

Confidential Information

During the performance of Trips, Drivers will have access to the "Confidential Information" of any third parties, including without limitation, the Confidential Information of Kaebox, Customers, and/or Trip recipients. "Confidential Information" means all information, whether oral, written, contained on electronic media or otherwise, to which a Driver is given or has access to, or is made available to the Driver in connection with the performance of Trips, including without limitation names, addresses, telephone numbers and other information which may be used to specifically identify a person ("PII" or "Personally Identifiable Information"), and the health information protected under the Health Insurance Portability and Accountability Act ("HIPPA" and "Protected Health Information").

Kaebox's personnel or Kaebox customer information, Customers, and/or Trip recipients of which a Driver becomes aware.

Kaebox and Drivers have specific obligations with respect to the protection of Personally Identifiable Information and Protected Health Information and a Driver is responsible for knowledge of the obligations and adherence thereto. Failure to meet these obligations will result in the Driver's permanent removal from the Kaebox Platform and the Driver shall be prosecuted to the fullest extent of the law.

Personally Identifiable Information: Personally Identifiable Information (PII) refers to information that can be used to distinguish or trace an individual's identity, either alone or when combined with other personal or identifying information that is linked or linkable to a specific individual. It is important to recognize that non-PII can become PII whenever additional information is made available — in any medium and from any source — that, when combined with other available information, could be used to identify an individual. Kaebox and Drivers are under a strict obligation not to use or disclose PII except, as necessary during the performance of Trips.

BY USING THE KAEBOX PLATFORM TO REQUEST/RECEIVE DELIVERY/SHIPPING SERVICES, YOU MAY BECOME AWARE OF THIRD PARTIES' CONFIDENTIAL, PROPRIETARY, PERSONALLY IDENTIFIABLE, AND/OR PROTECTED HEALTH INFORMATION. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT AS A USER OF THE KAEBOX APP, YOU ARE UNDER A DUTY TO MAINTAIN THE CONFIDENTIALITY OF ALL SUCH CONFIDENTIAL AND PERSONAL INFORMATION. UNDER NO CIRCUMSTANCES ARE YOU TO DISCLOSE SUCH INFORMATION TO ANY OTHER PERSON, OR USE SUCH INFORMATION FOR ANY OTHER REASON, THAN TO REQUEST/RECEIVE DELIVERY/SHIPPING SERVICES.

 

Restricted Items

A trip may entail the shipping service of a "Restricted Item" that may require a Driver to be 21 years of age or to possess special qualifications, equipment, permits, licenses, insurance, and physical capabilities, including Trips containing alcohol, cigarettes, HAZMAT and other regulated products. Customers are responsible for clearly describing the items included in a Trip so that a Driver knows whether or not they are qualified to offer to perform the Trip.

IT IS THE DRIVER'S RESPONSIBILITY TO BE KNOWLEDGEABLE AND COMPLIANT WITH ALL RULES AND REQUIREMENTS TO PERFORM A TRIP CONTAINING ANY RESTRICTED ITEMS PRIOR TO OFFERING A TRIP.

WHEN A DRIVER DISCOVERS AN ITEM THAT WAS NOT CORRECTLY DESCRIBED OR DISCLOSED BY A CUSTOMER IN A TRIP, THE DRIVER SHALL IMMEDIATELY NOTIFY KAEBOX AT HELP@KAEBOX.COM

IF A DRIVER CAN NOT COMPLETE THE DELIVERY OF A TRIP BECAUSE THE RECIPIENT DOES NOT PRODUCE A VALID ID AND/OR IS VISIBLY INTOXICATED, THE DRIVER SHALL IMMEDIATELY NOTIFY KAEBOX AT HELP@KAEBOX.COM FOR FURTHER DIRECTION.
